Actually, you do need permission if the copyright holder has so stipulated. That's why everyone and his dog hasn't put out a Beatles cover album - it's not permitted. The same is true of particularly possessive artists, and is frequently the case when songs are not old. A copyright owner has the right to make any stipulations he or she likes, within the life time of the copyright, which, in the case of lyrics and sheet music would, I believe, be the lifetime of the author plus fifty years. Not wanting to be argumentative, especially since I concede that I don't know all the details on this, but it does seem to me that there are Beatles covers on many, many records in my collection. (Glad I don't have the Golden Throats record, though, where I think it was William Shatner that did Lucy in the Sky with Diamonds.) And Laibach did cover one entire Beatles album (I think it was Let It Be). I'd make the argument that mechanical royalties make it just too expensive in most instances to include too many covers. It's an interesting--and very sticky--area of law, and it's complicated by the fact that copyright laws vary from country to country. I think that's been changed to plus seventy-five years. I just remembered that I know an entertainment lawyer. I usually only see him about once a year, but early August is when I usually run into him.
