It's not so simple. Allow me to put on my non-practicing lawyer hat for a minute (but this isn't legal advice, ok?). . I can think of some situations where this would be just fine. For example, if you clip a photo out from a magazine and paste or pin it on a shirt for your own use, you're probably within the fair use realm and don't need permission. If the photo were handed out or widely distributed with no explicit restriction on its use (like team photos handed out to fans) , you're also probably ok. From my filmmaker's understanding of copyright: The act of creating the design of the shirt is an original work or art, therefore YOU Clare, will hold copyright to the shirt design. The use of the bands proprietary images for this design is not technically legal, unless you have permission, or unless the use of said images is paramount to the meaning of YOUR artwork (as in parody) in which case you have a fair use claim under the First Amendment. (This is how Andy Warhol got away with the Campbell Soup cans.) As a practical matter, I think Fruvous has made it ABUNDANTLY clear that they have no objections to fans doing things like making shirts or making tapes or whatever from their output as long as it is for personal use. So Clare, by all means go and make your shirt. You arn't taking any revenue from Fruvous, because they don't have the shirt that you envision for sale.
