[VJohnson ] Re: Posting lyrics of unfinished songs ["A.J. LoCicero" Subject: Another Northhampton Discovery! Let me preface this by saying that I rarely get that excited by musical acts. As a musician myself, I find that so much of what is "out there" in the market is mediocre. But when I discover an artist or artists that truly transcend description, it fills me with joy. That happened when I discovered Fruvous in 1995. And it happened again last night. I had had a really shitty day--ending up bawling in the bathroom TWICE during work and the last thing I wanted to do was go to the Knitting Factory and see some musician that I didn't know, but about whom my friend Chaz kept raving. However, as soon as MARTIN SEXTON opened his mouth, I was hooked...line and sinker. I have never been as transported into a fan that quickly since, well, as I said before, 1995. Many of you may know of this guy from the Northampton area, but he was totally unknown to me. All I can say is that if you want to hear the most gorgeous voice, the best acoustic guitar-playing, the subtlest of lyrics, then please check out his newest album which he is on tour with right now (Atlantic Records). He plays again tonight at the Knitting Factory, and then I'm a bit clueless as to where he goes. He had the greatest drummer with him--Joe Bonadio (sp?)--who had all kinds of cool percussion toys. And I saw Sean Altman from Rockepella in the audience...(there's the Fruvous-related connection!). Anyway, peace...just wanted to pass along a great discovery! Well first of all, I said that I was looking at the moral implicatons of this, not the legal, so that isn't really relevant to the discussion as I drew it. Second, What you have outlined above may be the way it works in Canada, Hugo, but not in the US by any means. Here (at least) a work is copyrighted the moment it is created. Publishing has not one thing to do with it. Copyright notices are not needed either. The act of creation is the defining event. Copyright notices mailing of stuff to one's self and registering of works with various agencies are all legal tactics which are used to help prove and enforce copyrights, but the actual copyrights exist at the moment that the work comes into being. I know this, as I produce copyrighted material for a living. There is no chance by posting a band's lyrics on the internet that you could be opening them up to someone stealing their copyright (at least not in the US). As such a poster, one would, actually, be a witness to the fact that the lyrics belonged to the band in question, lending creedence to the copyright claim. > As for legalities of being sued for publishing the band's work, as long as all > work is properly referenced (ie: author/writer/performer/arr. by) your ass is > safe, so to speak. Actually that is not entierly true either. Copyright is the grayest of gray areas, but technically you may not reproduce a work in whole or in part (except as defined by fair use doctrine) without permission of the copyright holder. That includes posting lyrics to the internet. Is anyone gonna sue you for that? No. Could they? Yep. > Personally, I don't think it's a big offense to satisfy an urge by posting the > lyrics. So I guess if > someone really had no time on their hands, they could persecute me for > breaching publication laws / libelling / plaigering on the Internet. Probably for breeching copyright. Libelling involves telling negative untruths about someone, and plaigerizing involves taking credit for what is not yours. As long as you cite the author, you are not plaigerizing, but you are still violating copyright. > > (okay.. a bit long) You thought YOU were long! Any good, CHEAP place > to crash there? any Vermont FruMaison? :) I am sure I am not the best qualified to answer this, I'll take a stab at it since no one else has. By car, I think Montreal is about 2 to 3 hours from Burlington (I'm working backwards in my head from a different locale, so forgive my vagueness, pls). I don't know of any specific places to stay, but Burlington is a college/artsy town, so you may find some good B&Bs or hostels there. Or even just a cheap motel; Vermont has plenty of those! If you have the time/money, I recommend hanging around Burlington for awhile. There's plenty to see and do, IMHO. It's past foliage peak there by now (as it is in your neck of the woods), but I'm sure it's still quite pretty on the lake. > Also, who is thinking of going? Fantasizing is more like it! I still have that hook thing stuck in my cheek, which makes singing along to his songs a bit tough... > All I can say is that if you want to hear the > most gorgeous voice, the best acoustic guitar-playing, the subtlest of > lyrics, then please check out his newest album which he is on tour with > right now (Atlantic Records). I think what's amazing about this guy is that he can make an ordinary acoustic guitar sound like all possible intruments, and not necessarily one at a time. I only saw him twice and both times without a band, but the man definitely rocked my world for a few hours there! I almost liked how he sounded better solo than on the albums with his bands. That guy does wonders with electricity! Yay Marty! - -- Marie-Claude "I'm beside myself. I'm over there." "C'est bon?"
