To answer the original question the tape isn't available, the song is available from several sources that we don't seem to have a problem (ethically) with copying, if the indie tape is the most convenient source for you I say what the hell. Its not as if the Fruvous GE and H is a verbatim rendition of the Seuss original. I wouldn't have thought that you can claim copyright for a parody of your original art. (Not that Fruvous GE and H is a parody exactly, but you get the idea). Is Star Trek claiming dues for the intro to King of Spain? And if Seuss can claim extortionate dues for the song being on Live Noise then presumably they can do the same thing for each live performance. Don't see the logic.
