EMI in rip off probe to the tune of a quarter of a million quid with Food records In the U.K. Hi - I hope Thomas reads this one...... Food records was established by the keyboard player in Teardrop Explodes - Julian Cope's band. It was sold to EMI records in 1994. Food records by then had signed a band called Blur. When Food records was sold to EMI the deal was it was for a fixed amount of money about 475 000 quid - plus a percentage of the future sales of the next two Blur Albums. EMI gave Food records the percentage of the first Blur Album, but then released an obscure strange 80 000 print limited issue live CD, only making it available in Japan, before releasing their next multimillion selling Blur Album across Europe and the States and rest of the world. As a consequence Food records only got their percentage of the small obscure Japanesse only CD, and missed out on the mega bucks from the second 'proper' EMI Blur album. Anyway - Food records are now taking their case against EMI to the High court in London today in an attempt to get the court to agree that EMI did this deliberately to save them having to pay the percentage to Food records as agreed when they were first bought by EMI. Basically Food records' old owners are accusing EMI of deliberately doing the Japanesse release to deprive them of contractual royalty payments agreed as part of the initial sale of Food records. Food records are looking to win at least 250 000 [.25 million] Pounds in compensation. I dont know what problems Thomas had - if any - with EMI, but I thought this news story might be of interest to him because if Food records win their case and get compensation - and if EMI are found guilty of releasing the allegedly rubbish in Japan deliberately before releasing the next 'proper' Blur album then this might be interesting news for Thomas. Although I dont know whether the Venice in Peril and Parlephone label situation is the same as the Food records situation. If Thomas owned and sold the Venice in Peril label to EMI then possibly he might have been treated in a similar way and therefore be very interested in the outcome of this court case. Appropriately for Venice in Peril - it might open the flood gates for a host of similar claims contra EMI. If Food records wins. If nothing else, its a good example of how record companies can allegedly pull a fast one on their artists - if they buy up the artists original recording lable. So if Thomas wants more info he can contact Oliver at the Gaurdian newspaper. Gaurdian.co.uk. Begs the question did EMI make any obscure small issue only releases of Thomas's stuff? I don't know about quitting jobs and such (I'm sure everyone has to eat!) but Julie and I enjoy our painting very much. "A Dream That I Followed Her" I believe is the title - worth every cent that we paid for it. It is hanging in our studio/living room and so far is serving as the "inspiration piece" for that room. (Oh, sorry - a little too much Martha Stewart there - Julie has me watching wayyy too much HGTV I guess! :) So, that's my two cents. You only go through life once - - no one gets out alive - so do what you are best at and what you enjoy... Actually he isn't allowed to read Alloy or post anymore until he cheers up... but I'll be sure to forward your message to him! Incidentally just to calm any nerves out there... this "disciplinary action" is, of course, all very much okay and in good fun between he and I :) He's a good man and faithful painter and has dutifully gone to his studio where I've now sent him, with some freshly-stretched canvases and a pile of his favorite cds until he feels better. I really do want him to quit his job regardless of any financial setbacks it might initially cause. It would give him more time to focus on painting & marketing... and not having another source of income would give him more incentive to get his work out to galleries for prospective shows. And, how much more satisfying to pay bills with money earned from painting! I'm always well prepared to leap into the financial void and take asinine risks to move things along. Going hungry is a bit of a drag but you can't beat the intensity of it all. However Dave feels it's more logical to stick with the soul-sucking job at least until the car's payed for (he's right, it is more logical... ~sigh~) but he promises me he'll quit after that! I like your observation about life... this is how I feel too. It's a similar philosophy I suppose to that of Japanese WWII era soldiers who "gave their lives" to their country already, and considered themselves already dead even before their first involvement in battle.
