You can quibble about the mechanism, as I'm sure the record companies will do in court, but they aren't doing anything outside of the spirit of the copyright laws. If you buy music in one format (CD, tape, LP...), you have a well-established legal right to make copies in other formats for your own personal use (taping off a CD to listen to in the car, etc.). While with MP3.com's program you aren't the one making the actual copy, you are listening to music you have a legal right to listen to as the owner of that CD. For this to be illegal, the courts would have to rule that it's a violation of copyright law for a third party to provide copies of copyrighted material even if the person requesting the copies has a legal right to make and use those copies.
