For those that haven't, I don't think it's irresponsible to suggest that the future of the mp3 format is at stake with this lawsuit from the RIAA. If you haven't tried BEAM-it, there is a lot to like about this technology which, when you drop any CD in your player reads it and provides you with a web-based catalog of Mp3s that you can listen to anywhere. With a little hack you can even download MP3s of all the music you own (or the CDs that you have access to). The hitch here is that MP3.com has likely stepped outside both the letter and the intent of the 1990 Home Recording Act, which is what governs the recording of protected music in the US (and, de facto, around the rest of the world) Read the RIAA's letter to MP3.com here: http://www.riaa.com/piracy/press/012100.htm The real issue here is that MP3.com has gone from promoting unsigned artists (which protected them (and the mp3 format) from the record industry) to providing a commerical service using artists who have already been signed. In doing so, they may have dealt a death blow to the mp3 format. The crux of the debate is that the owner of music has the right to make a copy for their own use. The service provider does not have the right to make that copy for you. It's an interesting debate about who controls the music. If you really want to get into the frey, read the message boards. There are a lot of unhappy unsigned artists who feel betrayed by Mp3.com's move. - -------------------------------------------------------- D'Arcy Salzmann Strategic Partner Manager KL Group Inc. 260 King St. East Toronto, ON, Canada M5A 1K3 e: darcy@klgroup.com v: 416 643-3593 f: 416 594-1919 w: www.klgroup.com Software Development Productivity! - --------------------------------------------------------- - -----Original Message----- From: Member_Update@MP3.com [mailto:Member_Update@MP3.com] Sent: Thursday, January 27, 2000 1:20 AM To: darcy@salzmann.com Subject: Your Rights Under Attack by Record Industry - --------------------------------------------------------- Special announcement for My.MP3.com registered users. - --------------------------------------------------------- Thanks for being among the first group of pioneers to try our revolutionary new music service. We greatly appreciate all the ongoing support and feedback and hope that you've enjoyed the freedom to listen to your music when and where you want. Every day, thousands of people are "beaming" their CDs to My.MP3.com and taking advantage of Instant Listening (TM). As of today, here are the top 5 most popular CDs: 1. "Supernatural" by Santana 2. "Crash" by The Dave Matthews Band 3. "Surfacing" by Sarah McLachlan 4. "OK Computer" by Radiohead 5. "Dookie" by Green Day Although My.MP3.com is popular with consumers, the music industry is not as enthusiastic. The major record labels want to take away your right to listen YOUR music! They've filed a lawsuit against MP3.com to eliminate Beam-it(TM) and Instant Listening. To preserve your rights, we need your help. With each music fan that adds their CDs to My.MP3.com, our position against the record companies grows stronger. If each of you "Tell 10" friends about My.MP3.com, we'll have an army of music fans to fight the good fight. Hurry, please tell your friends to beam their CDs today!
