Correct. The songwriters get compensated when something they wrote gets
played on terrestrial radio. The performers of the songs do not (unless
you're Celine Dion and have taken a piece of the publishing share of the
songs she records).
And thanks to Shawn for correcting my own misunderstanding of the CRB
ruling. I was under the assumption that the webcasters were getting nailed
with a fee to cover songwriter performance royalties just like terrestrial
radio. I wasn't aware that the CRB was looking for a song performance
royalty. Which means that terrestrial radio continues to live in their
bubble of protection....but that's because labels 50 years ago wanted radio
to play their songs and no one ever organized a lobby group on behalf of the
recording artists to get their money (though this is now being addressed
retroactively from session players who have never made a dime beyond their
initial fee for playing on hit records).
I do sympathize with the webcasters (myself included). Any royalty not equal
to the audience size and number of spins like those on terrestrial is
restrictive of business.
