Exactly, Michael. That's what I've been trying to say all along. Where are
all the royalties paid by all manner of radio winding up? If the proposed
rate structure goes through, who exactly is going to count that money and
divvy it up properly? And where will the proposed $500 a year payment per
webcaster go? Interestingly, although they were able to decide on a rate
structure, nobody has figured out how the increased rates will be funneled
to artists.

It's just such a sad situation that, really, I want to cry.

I thought that Eytan made his point clear and I we've had this discussion in
person in NYC and Eytan is a perfect example to illustrate the royalty rate
question, "Where is all of that money going?".  Eytan and other artists on
this Audities list have been garnering airplay on our regular FM stations in
Hawaii in addition to the Live365 stream that we use.  The traditional FM
stations that I work at pay out huge monthly payments to ASCAP, BMI and
SESAC (in the thousands - more than the employees paychecks).  The same goes
for our monthly payments in royalties for those same organizations to
Live365 every single month.  We use their Pro player version which means we
have to pay more than the average user just someone listening doesn't have
to listen to commercials.  We don't receive any kickbacks for bringing in
more listeners.  Imagine our surprise that we are on TiVo's music channels
via Live365.  Again...no kickbacks.   This is off the original subject...
   
  What Eytan said is true.  As mentioned earlier, if we've been playing
artists like Eytan fairly consistant as say bands like; Tom Petty and The
Heartbreakers, Matchbox 20 or Fountains Of Wayne - why is it that Eytan and
other artists have not seen a penny?  It frustrates us as broadcast
programmers that we fill out music logs for these companies like BMI or
ASCAP that clearly list artist and song titles and artists like Eytan have
not been paid.  Eytan has been getting airplay from us for over six years
and yet Rob Thomas continues to get his royalty checks.   I thought that
internet was supposed to be an even better representation of airplay with
those ID tags, which again many artists I've spoken to who we've been
spinning almost everyday for the last four years have not seen internet
airplay on their royalty statements.  
   
  So artists like Eytan aren't getting their royalties and radio stations
like us are spending the biggest part of our budget to ASCAP, BMI and SESAC
without proof of payment to the artists that we play.  As you can see, I am
still confused to this very day, where all of that money goes (and
considering that I'm footing the bill for Live365 every month - I'd really
like to know).   Even with established acts from the late seventies and
early eighties that I've spoken with - have not seen airplay royalites from
their music that we've continue to play for twenty years!  I understand that
the Diane Warrens and Burt Bacharachs of the music world are covered for
their performances because their material is everywhere but the smaller acts
from major labels and indie acts deserve their share.
   
  Don't get me wrong, I know that are artists who are receiving their
royalty checks...I get a "thank you" a few times a year from different
artists for constant airplay.  Some are big and some are small payments but
it's always nice to know that some of our monthly budget does make it into
the pocket of the artist for a change.  
   
  Both traditional radio that streams online are in the same situation as
strictly internet radio with this royalty issue.   It will be interesting to
see how this plays out.
