I seek wisdom.
A band in the UK has just popped up with our name (Baskervilles). It looks
like they have been around for 3 months, and we have been around for 10 years
and have 2 releases. They don't seem to want to give up the name. Any
advice on what I should do?
1: You could sue them.
2: You could ignore them (although doing so would be legally construed as
failing to protect a copyright, I think, which could open the door to
them having a claim on the name).
3: Or you could see if they have any money behind them. If so, you could
sell them the name (obviously this requires a good bit of option 1 to
"encourage" their cooperation) and maybe make a pretty penny.
Keep us posted on how this develops, if you would.
