    There would be a digital code or footprint on legally downloaded
    songs from the source supplier (iTunes, et al). I'm assuming
    that's how it would tell the difference...but I have no
    first-hand knowledge.


  And if I created an MP3 from a legally purchased CD?

Yup - that was my next question. I can imagine that legally downloaded
tracks might have a digital marker of some sort, but that doesn't make
anything without the marker illegal.

And boy howdy, does Microsoft not want a piece of that firestorm. Still,
wouldn't be the first time they've done something stupid....
