Allmans, Cheap Trick Sue Sony BMG

The Allman Brothers Band and Cheap Trick on Thursday (4/27) filed a
class action lawsuit against Sony BMG, alleging the Sony Music
division is underpaying their royalties, using antiquated accounting
methods to determine what is owed on digital downloads. The suit
claims that Sony is not paying the artists 50 percent of the net
licensing dollars it receives for master recordings licensed to third
party digital delivery systems. It goes on to allege that Sony
continues to treat downloads as physical product, deducting 20 percent
for packaging and another 15 percent for breakage, which would not
apply to digitally delivered music.

"Sony Music is presently engaged in a widespread attempt to underpay
its recording artists," says attorney Brian Caplan, who represents
both bands and the class covered by the suit. "With the technological
advancements in the music industry, where many people download songs
to their iPods and other portable devices, it is essential that
artists receive the royalty income to which they are entitled."

The suit seeks 30 cents of every 70 cents that Sony Music is paid for
each digital song sold, as opposed to the 4.5 cents they currently
paid to artists.
