Jackson and SONY/ATV (who administer) would have to go to court and make a
case for ownership based on grandfathering the existing deal they currently
have. But both McCartney and Lennon's estates would no doubt attempt to
fight them based on the known expiry of the copyright ownership itself.
Still, the potential is there for these songs to fall into public domain
sometime down the road because copyrights on songs aren't renewable....the
clock is ticking.
There was a precedent setting case in the US with the Walt Disney
corporation who had copyright laws changed several years ago so that the
copyright on Mickey Mouse could be extended....otherwise it would have
reverted to public domain on his 75th birthday. I don't recall what the
extension period was, but Disney will safely own Mickey for another lengthy
period until they battle to have the law changed again to meet their needs.
It seems the copyright on songs need to be looked at too....and I can't
imagine what the film industry is going to do when copyrights on the biggest
movies of the 1940's start lapsing.
