Hey and Help Audities Peeps,
I know we have some Lawyers on the list as well as Indie Record Label
Owners, so I thought I would go here first for some advice. I just
found out this past week that an indie label has released this year a
CD that was recorded/released by my and our guitarist's old hair metal
band way back in 1989. This was released without our knowledge or OK
and a friend of ours told us about it.I won't mention the label, seems
pretty small time but they are selling CD's on ebay at $14.99 a crack,
and they are selling. We had only released it on cassette back in 89,
so they must have mastered it off a cassette. Our guitarist purchased
one and say's it's for sure, not a CDR and it has The Artwork and what
not from then original cassette, they just put on their logo and info.
Now back in the day, we copyrighted the songs, but not the actual
cassette itself and they have printed on the CD itself All Rights
Reserved.Why they released this, I have no Ideal. I mean it was pretty
good for the time period, but you know it soooo hair metal!!
Our conflict is, we think it's cools that someone put it out on CD,
since it never was. But we would like to have some input and maybe
master it from the Dat tapes, as well as receive some cash for it. I
mean they are selling on Ebay. How best should we approach them, should
we say Cease and Dissist or contact a lawyer and let them deal with it?
Or should we say, "Hey we are in the band and we didn't give you
permisson to use our music, let's discuss this matter" I'm sure they
thought the members are no longer in the business, but all our us are
except 1 guy.
Any Ideals???
