First...anyone stop and think that Fountains Of Wayne may not even be
responsible for the placement of this song in the Dr.Pepper ad? Or the NFL
ad? If their label paid for the recording, and the licensing for synchro and
mechanicals was cleared (and, again, most probably through the band's
publisher -- which may not have an affiliation to anyone IN the band) they
can do whatever they want with the song and not even have to ask permission
of FOW. I could be wrong as I don't know whether the band controls the
record or not....but if they do own their own rights then:
Second....it's not selling OUT....it's just selling. That's why it's called
commercial music -- because people sell it and other people BUY it.
If one's goal is to live altruistically by the code of the "starving artist"
then you better not be signing any record deals, publishing deals or
management deals. Cause chances are someone's going to at least TRY and make
some money. It doesn't always work out that way (many destitute artists are
proof positive in the failings of such a system), but SOMEONE in that chain
of command *is* going to try and make the act some money....and if money
isn't what you want, then why the hell are you pursuing a career in music in
the first place? The chicks? The glory? C'mon...
