I would check with the publishing company. It seems most of the industry is
still in a "wait and see" frame of mind. Our upcoming Beatles tribute CD set
just ran into this exact snag. SONY/ATV have verbotten the MP3 availability
of digital downloading and streaming of their songs...in any
form...original, cover tune or muzak version. It was a good thing we checked
too, because apparently the penalty is pretty hefty from our loveable
MopTops and Rotting Apple Corp.
We even had a very famous artist actually WRITE a song for one of our acts,
which was recorded and released on a recent CD...and now they've pulled the
rights to us making it available online because they need to "assess the
legalities of this new technology".
In response, I'm removing the song from the album....fuck him.
